ACCEPTANCE OF THESE TERMS
- By accessing or using our Site or the QuickCompare platform (Platform), you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree, you must not use our Site or Platform.
- These Terms of Use apply to all visitors and users of the Site and Platform. If you have entered into a Platform Agreement with us (either our Individual Use Terms or our Business Use Terms), those terms also apply to your use of the Platform and, where there is any conflict, the Platform Agreement takes precedence.

- We may update these Terms of Use from time to time. We will notify you of material changes by posting a notice on our Site or by email. Every time you wish to use our Site or Platform, please check these terms to ensure you understand the terms that apply at that time. Your continued use of the Site or Platform after we post changes constitutes your acceptance of the revised terms.
ACCESS AND AVAILABILITY
- Our Site is made available free of charge. We do not guarantee that our Site, Platform, or any content on them will always be available or be uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of our Site or Platform for business and operational reasons.
- You are responsible for ensuring that all persons who access our Site and Platform through your internet connection are aware of these Terms of Use and that they comply with them.
YOUR ACCOUNT
- If you create an account on our Platform:
- you must keep your login credentials confidential and not share them with any other person;
- you are responsible for all activity that occurs under your account;
- you must notify us immediately if you become aware of any unauthorised access to your account; and
- we reserve the right to disable your account at any time if, in our reasonable opinion, you have failed to comply with any provision of these Terms of Use or your Platform Agreement.

HOW YOU MAY USE OUR SITE AND PLATFORM
- All intellectual property rights in our Site and Platform (including the Software, QuickCompare, Ziggy, the underlying technology, and all content published on them) belong to us or our licensors. Those works are protected by copyright, database right, and other intellectual property laws. All such rights are reserved.
- You may:
- view and navigate our Site for your personal or internal business use;
- print or download extracts from our Site for your own reference; and
- share links to pages on our Site with others.
- You may not:
- copy, modify, adapt, reproduce, republish, or distribute any content from our Site or Platform except as permitted by these Terms or your Platform Agreement;
- use any content from our Site or Platform for commercial purposes without obtaining a licence from us;
- frame or mirror any part of our Site on any other website; or
- use our name, logo, or branding without our prior written consent.
- Your use of the Platform (including uploading datasets, running evaluations, and using Ziggy) is also governed by your Platform Agreement. The intellectual property rights in Platform Outputs and our rights to use aggregated, anonymised data are set out in your Platform Agreement and the Intellectual Property, Output Ownership and Usage Rights document available on our Site.
ACCEPTABLE USE
- You may use our Site and Platform only for lawful purposes. You must not:
- use our Site or Platform in any way that breaches any applicable local, national, or international law or regulation;
- use our Site or Platform to transmit, store, or distribute any content that is unlawful, harmful, defamatory, obscene, infringing, harassing, or discriminatory;
- introduce or attempt to introduce any viruses, malware, trojans, worms, or other malicious or harmful code;
- attempt to gain unauthorised access to any part of our Site or Platform, or to any server, computer, or database connected to our Site or Platform;
- conduct or attempt to conduct any denial-of-service or distributed denial-of-service attack;
- conduct, facilitate, authorise, or permit any text or data mining or web scraping in relation to our Site or Platform without our prior written consent; or
- use our Site or Platform to harvest, collect, or store personal data about other users without their consent.
- A breach of clause 8.1 may constitute a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and co-operate with those authorities by disclosing your identity.
- You may use our Site and Platform only for lawful purposes. You must not:
PROHIBITED USE OF AUTOMATED TOOLS
- You must not use any automated tools (including bots, spiders, scrapers, or crawlers) to access, monitor, copy, or extract content from our Site or Platform, except to the extent that:
- the Platform expressly provides API or programmatic access as part of your Service Plan; or
- you have obtained our prior written consent.

USER-GENERATED CONTENT
- Where you upload data, prompts, or other content to the Platform:
- you retain ownership of that content (subject to any licence you grant us under your Platform Agreement);
- you are responsible for ensuring that content complies with applicable laws and does not infringe any third-party rights;
- content must not be defamatory, obscene, offensive, hateful, or inflammatory;
- content must not infringe any copyright, database right, trade mark, or other third-party intellectual property right;
- content must not contain or promote illegal activity or content; and
- content must not be in contempt of court or threatening to any person.
- We reserve the right to remove any content that does not comply with these standards.
- Where you upload data, prompts, or other content to the Platform:
ZIGGY AI ASSISTANT
- Ziggy is Trismik's AI-powered customer assistant integrated throughout the QuickCompare Platform. Ziggy is designed to help you onboard evaluation data, navigate model comparisons, and interpret results.
- Ziggy may produce incorrect, incomplete, or misleading information, including in relation to pricing, costs, account limits, overdraft thresholds, and the terms of your agreement with us. The authoritative source for all such matters is your Platform Agreement and the information displayed in the platform user interface. You should always verify Ziggy's suggestions before acting on them. Trismik accepts no liability for decisions made in reliance on Ziggy's outputs.
- Your interactions with Ziggy are processed in accordance with our Privacy Policy and your Platform Agreement. By using Ziggy, you consent to Trismik using your Ziggy interaction data to train and improve the Ziggy AI model, as further described in our Privacy Policy.
THIRD-PARTY LLM PROVIDERS
- QuickCompare enables you to send evaluation prompts to third-party large language model providers (LLM Providers) including OpenAI, Anthropic, Google, Meta, Mistral, Cohere, and Amazon, among others.
- Each LLM Provider's services are governed by their own terms of service and privacy policies. We encourage you to review those terms before selecting a provider. We are not responsible for the performance, availability, or data practices of any LLM Provider.
- In Resale Mode, we act as a technical intermediary transmitting your data to the LLM Provider you select. In BYOK Mode (when available), your API keys are used and you have a direct relationship with the LLM Provider for inference services.
- LLM Provider pricing is determined solely by the relevant LLM Provider and is passed through to you at cost. Such pricing may change at any time in accordance with the LLM Provider's published rates and is not subject to the price change provisions set out in your Platform Agreement. Estimated current LLM Provider pricing is displayed in the platform user interface before each Evaluation Run, but such estimates are indicative only.
SANCTIONS
- You must not access or use our Site or Platform if you are subject to sanctions imposed by the UK, EU, UN, or US, or if you are located in or operating from a country subject to comprehensive sanctions.
- We reserve the right to restrict, suspend, or terminate access to our Site or Platform where we reasonably believe a user is subject to applicable sanctions laws or that continuing to provide access would cause us to breach sanctions obligations.
LINKS TO AND FROM OTHER SITES
- Our Site may contain links to third-party websites and resources. Those links are provided for your information only and do not constitute our endorsement of those sites or their content. We accept no responsibility for them.
- If you wish to link to our Site, you may only do so in a way that is fair and legal and does not damage our reputation. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part unless we have given our prior written consent.
OUR LIABILITY TO YOU
- Nothing in these Terms of Use limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited by law.
- To the extent permitted by law, we exclude all implied conditions, warranties, representations, or other terms that may apply to our Site or any content on it.
- We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with:
- use of, or inability to use, our Site or Platform;
- use of or reliance on any content displayed on our Site or Platform;
- decisions made in reliance on outputs from Ziggy, including in relation to pricing, costs, account limits, or the terms of your agreement with us; or
- downtime, errors, or failures by third-party LLM Providers.
- We will not be liable for any loss of profits, loss of sales or business, loss of revenue, loss of anticipated savings, loss of business opportunity, goodwill, or reputation, or any indirect or consequential loss or damage.
- Nothing in these Terms of Use limits or excludes our liability for:
VIRUSES AND SECURITY
- We do not guarantee that our Site or Platform will be secure or free from bugs, viruses, or other malicious code. You are responsible for configuring your own technology to access our Site and Platform and should use your own virus protection software.
GOVERNING LAW AND JURISDICTION
- These Terms of Use and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales.
- The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use.
